Benami Property Law / Benami Litigation

Practice relating to proceedings under the Prohibition of Benami Property Transactions Act, including adjudication, appeals and connected litigation before statutory authorities, the Appellate Tribunal and Courts.

The Benami law practice covers proceedings arising under the Prohibition of Benami Property Transactions Act, 1988 and the rules made thereunder.

The work includes matters concerning initiation of proceedings, provisional attachment of property, references before the Adjudicating Authority, confiscation proceedings and other issues arising under the statutory framework governing alleged benami transactions.

The appellate practice includes preparation and conduct of appeals and applications before the Appellate Tribunal for Forfeited Property (ATFP), where exercising jurisdiction in Benami matters, and proceedings before High Courts and other judicial forums, as applicable.

Work undertaken includes examination of notices, attachment orders and adjudication orders; preparation of replies, appeals, applications, paper books and written submissions; legal research; and representation in hearings and appellate proceedings.
